Comprehensive Standard: 3.2.6
 There is a clear and appropriate distinction, in writing and practice, between the policy-making functions of the governing board and the responsibility of the administration and faculty to administer and implement policy.

Statement of Compliance: The University of Texas-Pan American maintains a clear and appropriate distinction, in writing and practice, between the policy-making functions of The University of Texas System Governing Board of Regents and the responsibility of The University of Texas-Pan American administration and faculty to administer and implement policy.
 
Narrative: Functions of the Board may be found in the UT System Board of Regents’ Rules and Regulations, Series 10402, Section 1, Subsections 1.5-1.9. Appropriate distinctions are made, in writing, that the Board of Regents is responsible for the policymaking of the institution and fulfills its responsibilities through a number of standing committees that include “(a) Finance and Planning Committee; (b) Academic Affairs Committee; (c) Health Affairs Committee; (d) Facilities Planning and Construction Committee; (e) Audit, Compliance, and Management Review Committee.”
 
Additionally, the functions of administration may be found in the Regents’ Rules and Regulations, Series 20102, Section 1 & 2 where appropriate distinctions are made, in writing, that the UT System Administrators including the Chancellor, the Executive Vice Chancellor for Academic Affairs, other system administrators, and the institution’s president are responsible for the administration and execution of the policies the Board has established. The specific responsibilities for the Chancellor are clearly defined in the Regents’ Rules and Regulations, Series 20101, Section 3.
 
The functions of the President of The University of Texas-Pan American (UTPA) are to serve as Chief Executive Officer of the University and to be responsible for implementing the policy established by the Board of Regents. As specifically outlined in Regent’s Rules and Regulations, Series 20201, Section 4, the Chief Executive Officer has general authority and is expected to “develop and administer plans and policies for the program, organization and operation of the institution.” The policy regarding administrative authority and responsibility of the President is also documented in the University’s Handbook of Operating Procedures, Section 3.3.1. The President exercises this authority in many ways, one of which is by overseeing the development of the University’s budget, which funds the various programs that operate within the university.
 
The functions and duties of the deans can be found in the Handbook of Operating Procedures, Section 6.5.2 which includes coordination, assessment and development of academic programs and articulating policy and procedure to faculty. Regents’ Rules and Regulations, Series 31004, Section 4 outlines the general and primary duties of faculty of the university. Faculty members are expected to: teach, study, research, promote student research, perform administrative tasks and make contributions to students and the community. They also have a major role in shaping the institution’s academic policies, admission and graduation requirements as presented in the Handbook of Operating Procedures, Section 6.5.4 which reflects Faculty Duties and Responsibilities.
 
Actions taken by the Faculty Senate reflect the governance, discussion, and actions of the faculty in recommending policies and discussing faculty-related matters, including admission and graduation requirements.
 
An example of the Board establishing policy may be found in the Minutes of the Board of Regents, May 11-12, 2005 meeting, in which the Regents approved policies related to the fiscal year 2006 budget and preparation. The UT System Administration provided guidelines on the implementation of this policy with the institutional president implementing the policy in the fiscal year 2006 budget; subsequently receiving UT System Board of Regents' approval for the FY 2006 budget at the August 2005 Board meeting.
 
Another example of the policy-making function of the Board of Regents may be found in the April 1, 2005 Board minutes, which reflect approval of The University of Texas-Pan American Mission Statement. This statement was developed with significant input from the faculty, then recommended to the UT System Administration before receiving its final approval by the Board of Regents. UTPA's President used this approved mission statement to begin the planning process on campus and develop the University’s six goals for 2012.
